  41.       Nimonik is a complete computerized learning environment designed to
  42. help adults learn and memorize almost any subject.  Nimonik is not a game
  43. or children's educational program.  Fast, efficient, and easy to use;
  44. everything is menu-driven.  Nimonik really works.  Here's how:
  45.  
  46.     You enter everything you need to learn or memorize into NIMONIK.  It
  47. then helps you drill, review, and test on the material quickly and
  48. effortlessly.  NIMONIK automatically keeps track of where your weaknesses
  49. are and gives you the most practice in those areas, thus saving you hours
  50. of time and work.
  51.  
  52.     It helps you organize and manage your learning too:  you can print,
  53. edit, add, copy, merge, etc.  Multiple users can study multiple subjects. 
  54. Files can be as large as your disk space will allow.
  55.  
  56. What subjects can NIMONIK help you with?  Here's a portion of the list:
  57. English, Latin, physiology, microbiology, botany, zoology, philosophy,
  58. history, bible study, computer terminology, economics, social studies,
  59. sociology, psychology, geography, geology, political science, law, real
  60. estate, corporate policy, accounting, business, insurance, management,
  61. finance, marketing, and any subject where you have to learn or memorize
  62. terms, words, ideas, concepts, names, places, or dates.  It can even help
  63. you raise your scores in the GRE, LSAT, GMAT, SAT, or ACT.

  65. You probably wonder how people wrote anything before word processors. 
  66. After you've used NIMONIK you will wonder how people learned anything
  67. before NIMONIK.

  69. All you need is an IBM compatible computer (or access to one) with at
  70. least 448K memory, one or two floppy drives (hard disk recommended but not
  71. necessary), and any kind of monitor.

  73.     Nimonik is menu-driven and easy to use.  The printed manual which
  74. comes with the Registered Version of Nimonik should cover any function or
  75. operation that the user may need to know about.  It is, however, necessary
  76. to stress a few points in order to ensure maximum benefit to the user from
  77. this product.

  92.                                  page 1     The most important difference between Nimonik and other learning
  93. programs is that Nimonik keeps track of where your weaknesses are.  This
  94. feature alone will save you untold numbers of hours of work and
  95. frustration when learning or memorizing your subjects.  The way you learn
  96. is first of all by being forced to condense and organize your material
  97. during the ADD option which will also force you to understand the
  98. material.  Then TEST will let you know how well you know the material. 
  99. DRILL is the single most important activity in Nimonik.  DRILL will drill
  100. you on those terms that you need the most help with.  You should spend
  101. most of your time in the DRILL option.  Finally, REVIEW, will ensure that
  102. you have covered all the terms you need to know.  All these activities
  103. (REVIEW, TEST, and DRILL) keep track of which terms you know and which you
  104. don't know, but only DRILL actually uses that information.  TEST chooses
  105. terms at random, and REVIEW chooses terms sequentially as you entered
  106. them.

  108.     In order to begin using the four example files provided on the
  109. Subject Disk, the files must first be installed by the following
  110. procedure: Simply copy the four files to your chosen directory (You MUST
  111. use the DOS copy command to do this).  Then load Nimonik and pick the
  112. RESET option from the MANAGE MENU.  You will not be able to use these four
  113. example files until you RESET them in this manner.

  115. THE SHAREWARE CONCEPT
  116.

  118. funds to continue operating and providing you with quality software and
  119. support.  The Shareware Concept is a marketing strategy that benefits both
  120. the user and the software companies.  We benefit by being able to bring to
  121. the public a product with less capital investment.  This allows us to pass
  122. on the savings to you so that you can obtain quality software at much
  123. lower prices.  Not only that, but you get to "try it before you buy it".

  125. If you find this product to be useful and helpful in your student or
  126. professional career, please register and pay the registration fee.  Not
  127. only will you then get a warm feeling all over, but if your Shareware
  128. Version Serial Number gets enough distribution you could actually make
  129. some money.  We think it only fair to reward you for helping us to market
  130. Nimonik.  Read on for more details.

  139. There are two versions of Nimonik 1.0: the Registered Version and the
  140. Shareware Version.  The Registered Version is the full-blown version that
  141. you get when you purchase, pay for, and register Nimonik.  IT IS ILLEGAL
  142. FOR YOU TO COPY, SELL, OR DISTRIBUTE THE REGISTERED VERSION (see the
  143. license agreement below).  The Shareware Version differs in that it only
  144. allows for 50 entries per file and limits the number of learning sessions. 
  145. You may copy, distribute, upload or download to Bulletin Boards via modem
  146. the Shareware Version if you follow these restrictions:
  147.  
  148. 1) You must not modify, delete or add to the object code or the number of
  149. existing files.
  150.  
  151. 2) You may not receive any compensation or money for the copy you are
  152. distributing except as follows:
  153.  
  154. a) Clubs and user groups may charge a nominal fee (less than $10) for
  155. expenses and handling while distributing the Shareware Version of Nimonik.
  156. (Payment of such fees cannot be applied towards the registration of
  157. Nimonik).
  158.  
  159. b) Bulletin Boards may charge nominal access fees as long as the fees are
  160. not exclusively applied to Nimonik.  Only the Shareware Version can be
  161. allowed on Bulletin Boards.  Under no circumstances should the Registered
  162. Version be allowed on any Bulletin Board. (Payment of such fees cannot be
  163. applied towards the registration of Nimonik).

  165. c) For each paid registration of Nimonik resulting from your own personal
  166. Shareware Version Serial Number you will be paid $10.00 by Zoft Systems.  
  167.  
  168. d) For each paid commercial site-license of Nimonik resulting from your
  169. own personal Shareware Version Serial Number you will receive a 25%
  170. commission from Zoft Systems.
  171.  
  172. Both the Registered Version and the Shareware Version of Nimonik are
  173. copyrighted and fully protected by all applicable laws.  Neither version
  174. is free.  The Shareware Version can be used for a trial period of no more
  175. than 15 (fifteen) days.  If you like the Shareware Version, you are
  176. required to send in the included Registration Form along with the required
  177. sum.  When you register please include the Serial Number of the Shareware
  178. Version you have been using.  This will entitle you to a $5.00 discount. 
  179. Registering will not only give you all the benefits as described below but
  180. will enable you to receive your own Serial Number Shareware Version from
  181. which you can earn $10.00 for each copy registered with Zoft Systems. 
  182. Thus, you are not only permitted to copy and distribute the Shareware
  183. Version but are encouraged to do so and even rewarded.

  185. ALL COMMERCIAL SALES MUST FIRST BE APPROVED IN WRITING BY ZOFT SYSTEMS.

  192. The following license agreement applies only to the Registered Version of
  193. Nimonik.  Registered Version is defined as the version that you have
  194. purchased and paid for and that you have registered by filling out and
  195. sending the Registration Form to Zoft Systems.  This license agreement
  196. does not apply to the Shareware Version.  You are not eligible to any of
  197. the terms in this license agreement if you have not registered and paid
  198. for your copy of Nimonik.
  199.  
  200. This software product is licensed to you to use on a single machine. 
  201. However, it may not be used by more than one person nor on more than one
  202. machine simultaneously.  You may not network this product.  You are
  203. permitted to make up to two copies solely for archival or backup purposes.
  204. You may transfer the program on a permanent basis and license it to
  205. another party if the third party agrees to accept the terms and conditions
  206. of this agreement.  If you transfer the program, you must at the same time
  207. either transfer all copies of the program regardless of form to the same
  208. party or destroy any copies not transferred.
  209.  
  210. This license shall be effective from the date you open this package and
  211. remain in effect for a period of twenty-five (25) years unless terminated
  212. sooner as provided in this agreement.  You may terminate this license at
  213. any time by destroying all copies of the program (in any form).  Your
  214. license terminates automatically if you fail to comply with any terms or
  215. conditions of this agreement.

  217. LIMITED WARRANTY
  218.  
  219. The following limited warranty applies only to the Registered Version of
  220. Nimonik.  Registered Version is defined as the version that you have
  221. purchased and paid for and that you have registered by filling out and
  222. sending the Registration Form to Zoft Systems.  This limited warranty does
  223. not apply to the Shareware Version.  You are not eligible to any of the
  224. terms in this limited warranty if you have not registered and paid for
  225. your copy of Nimonik.
  226.  
  227. Zoft Systems warrants that the program will conform, as to all substantial
  228. operational features, to Zoft Systems' current published specifications,
  229. documentation and authorized advertising; that, the user documentation
  230. accompanying the program contains the necessary information to utilize the
  231. program; and that, the media on which the program is furnished shall be
  232. free from defects in materials and workmanship for a period of ninety (90)
  233. days from the date of delivery to you as evidenced by a copy of your sales
  234. receipt.  Except for the Limited Warranty set forth above, the program is
  235. provided "as is."  Zoft Systems makes no other Warranty, express or
  236. implied, with respect to the program and specifically disclaims the
  237. implied warranties of merchantability and fitness for a particular
  238. purpose.  Zoft Systems does not warrant the program will meet your
  239. requirements or that the operation of the program will be uninterrupted or
  240. error free.  You are solely responsible for the selection or the program
  241. to achieve your intended results and for the results actually obtained.

  243.                                  page 4 LIMITATIONS OF REMEDIES AND LIABILITY

  245. In the event the program fails to meet Zoft Systems' "limited warranty,"
  246. Zoft Systems' entire liability and your exclusive remedies shall be:
  247.  
  248. A.  The replacement of any program not meeting Zoft Systems' "limited
  249. warranty" which is returned to Zoft Systems or any authorized dealer with
  250. a copy of your sales receipt.
  251.  
  252. B.  If Zoft Systems cannot or will not replace the program, you may
  253. terminate this Agreement up to one year after date of purchase by
  254. returning the program and all copies to Zoft Systems and your money will
  255. be refunded.
  256.  
  257. Under no circumstances, and notwithstanding any failure of the essential
  258. purpose of any limited remedy provided herein, shall Zoft Systems, or any
  259. of its program developers, or any other of its employees, be liable to you
  260. for any damages, claims or losses whatsoever, including but not limited to
  261. any claims for lost profits, lost savings or other special, incidental or
  262. consequential damages arising out of the use or inability to use the
  263. program regardless of the circumstances.

  265. Except as expressly provided for in this license, you many not use, copy,
  266. modify, reproduce, transfer or distribute the program in whole or in part,
  267. without first obtaining Zoft Systems' written permission.

  317. 6)  You will be eligible to buy New Subject Files as soon as they become
  318. available for small fees: $5.00 for 1 Subject File, or $3.00/file for 2 or
  319. more files, plus $3.00 shipping and handling.  (Planned Subject Files are
  320. Real Estate, Legal Terms, Biology, Medicine, Economics, History, Business,
  321. a much expanded English Vocabulary, and many more.)
  322.  
  323. 7)  You will be able to submit your own Subject Files and earn $.10 (ten
  324. cents) per entry used (an entry is a word or term and its definition) + a
  325. percentage of the sales.  (20% to Zoft Systems, 80% divided among all
  326. submitters based on the number of entries used for each Subject).
  327.  
  328. 8)  You will receive a Shareware Version of Nimonik with your own personal
  329. Shareware Serial Number which you will be encouraged to distribute to your
  330. friends and colleagues either by giving away Shareware copies or by
  331. uploading the Shareware copy to computer bulletin boards.  (Most BBS
  332. Sysops will welcome your contributions).  For every sale based on your
  333. Shareware Serial Number you will receive a commission of $10.00 (ten
  334. dollars).  We want to reward you for helping us to market Nimonik and at
  335. the same time we wish to discourage you from giving away the real, full-
  336. blown Registered Program.
